Welcome to the Orange Duffel Bag Initiative (“ODBI”). ODBI provides certified life coaching and ongoing advocacy for our nation’s most vulnerable high school and college students, helping them achieve education success.

ODBI empowers students in need to create their own individual, dynamic life plans, and supports them in formulating and achieving their goals.

This Privacy Policy (“the Policy”) governs the way ODBI collects, uses, maintains and discloses information collected from users (each, a “User”) of the https://www.theodbi.org website (“Site”). The ODBI respects your privacy and is committed to collecting, maintaining, and using personal information about you responsibly.  This Policy applies to all of your use of the Site including services and programs offered through related sites including, but not limited the After School Programs, Coaching for Completion and Volunteer registration. To the extent that any of these services or programs include specific privacy policies or terms and conditions, they will take priority over this Policy. This Policy describes how your information will be treated as you use the Site. Please note that separate privacy policies apply to any and all donations collected through the Click & Pledge website (“Donations”), to the ODBI Partner websites, and to our Partner Coaches’ websites.

Agreement:

By voluntarily submitting your Personal Information to the Site you consent to the collection, storage, processing and use of your personal information on the basis described herein. If you do not agree, please do not provide any personal information via the ODBI Websites.

CHANGES TO THIS PRIVACY STATEMENT

We will update this Policy from time to time, so please check back periodically.

If at any point we decide to use Personal Information in a manner that is materially different from that stated at the time it was collected, we will endeavor to notify you of such changes (e.g., we will post a revised Policy with a new effective date, display the word “updated” next to the Privacy Policy link on each page on the ODBI Websites, or otherwise) prior to implementing them.

Any information collected under previous versions of this Policy will then become subject to the terms of our new Policy.

Personally Identifiable Information (“PII”)
We may collect PII from visitors, volunteers, or donors when you provide it voluntarily.  PII can include data such as names, addresses, ZIP codes, birthdays, and e-mail addresses.  It may also include web browser data that we may use for analytics and Site functionality purposes, including using web browser cookies to improve your user experience.

We may collect “PII” from Users in a variety of ways, including, but not limited to, when Users visit our site, fills out a form, participate in a video or photo shoot, and/or in connection with other activities, services, features or resources we make available on our Site. Users may, however, visit our Site anonymously. Users can always refuse to supply PII, however it may prevent them from engaging in certain Site related activities.

Exclusion:

We do not intentionally collect PII from, or direct this Site to, anyone under 13 years old or people outside the United States of America.  If you are a minor (or a parent/guardian of a minor) or visiting the Site from outside of the United Stated of America and wish to visit our Site, volunteer, or donate to our organization, please contact us at

Information we collect:

 

ODBI Site collect the following PII about Users.

  1. a)    Site Use Information

ODBI collects technical information relating to each time a User comes to an ODBI Site including IP address, browser type and version, time zone settings, browser plug-in types and versions, operating system and platform type (e.g., Internet Explorer browser on a Windows platform).

We may also collect information about your visit, including pages you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number.]

Gathering this technical information helps us to learn what browsers we need to support and helps us determine what sections of the ODBI Site are most popular and how many visitors come to our Site. You do not have to register with ODBI before we can collect this information.

  1. b)    Information Provided to ODBI:

You (or in the case of ODBI Student Programs, your Guardian) may provide PII to us which may include your name, home and/or work email address, postal address, phone number and/or fax number, your employer and job title, demographic information about you including birth year, GPA, educational enrollment, financial aid status, academic enrollment, attendance records, etc.. Such information is only required to take advantage of optional programs and services provided through the Site.

ODBI collects PII in the following ways from different parts of the ODBI Site:

  • Volunteer Applications: You share PII with us when you complete an application to volunteer with ODBI through the Site. PII provided by ODBI volunteers is stored in a secured location for 5-7 years due to grant requirements and volunteer needs.   • Students:  You share PII with us when you complete a secure ODBI Student Registration form on our Site. PII provided by students and guardians is stored in a secure location for 5-7 years due to grant requirements.  If you have any questions about your PII, please contact us at: privacyinquiry@theodbi.org
  • Other Registration: When registering for specific services we may ask for the same type of PII. For example, when we may ask you to sign a photo/video release for educational purposes, to run a promotion or contest, survey, or if you subscribe to an e-mail newsletter, we will ask you to provide your e-mail address. Notice to Individuals in the State of California Your Rights to Your Personal Information

California Users have the right to request that ODBI (i) provide you with access to the PII that we hold about you, (ii) correct your PII, (iii) delete your PII, and (iv) cease or restrict disclosures or sales of your PIII to third parties. ODBI does not sell any User PII to third parties.  You also have a right against discrimination for exercising any of these rights, which ODBI is committed to upholding and honoring. What are “cookies” and how does ODBI use them?

A cookie is a small text file containing a unique identification number that is transferred from a website to the hard drive of your computer. This unique number identifies your web browser to ODBI computers whenever you visit the Site.

The Orange Duffel Bag Initiative may collect and use Users PII for the following purposes:

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, and data.

 

Sharing your personal information

We do not sell, trade, or rent Users PII with any third parties. ODBI does not sell any Users PII and will only share PII as necessary to process the necessary applications and provide services to you.

We may share generic aggregated demographic information not linked to any PII regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.


Electronic newsletters

If a User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc.  Should you choose to change these preferences (opt-out), please contact us at privacyinquiry@theodbi.org to unsubscribe.

Third party websites

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies.

Advertising

Ads appearing on our Site may be delivered to Users by advertising partners, who may use third party cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile non-personal identification information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. Google Adsense

Some of the ads on our Site may be delivered using Google AdSense. Google’s use of the DART cookie enables it to serve ads to Users based on their visit to our Site and other sites on the Internet. USER MUST COMPLY WITH APPLICABLE LAWS

You are solely responsible for ensuring compliance with the laws of your specific jurisdiction.  We do not target Users or provide services in the EU or the EEA or any other jurisdiction outside the United States.

MISCELLANEOUS

In the event that any portion of the Agreement is held to be invalid or unenforceable, the invalid or unenforceable portion shall be construed in accordance with the applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the Agreement shall remain in full force and effect. The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Agreement. If We fail to enforce strict performance of any provision of the Agreement, such failure will not constitute a waiver of our right to subsequently enforce such provision or any other provision of the Agreement. Neither the course of conduct between you and Us nor trade practice shall act to modify any provision of the Agreement.

The Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, except with regard to its conflicts of law rules. Any action relating to the Content, Site or the Agreement must be brought in the federal or state courts located in Atlanta, Georgia or the county in which We primarily operate, and you hereby irrevocably consent to the jurisdiction of such courts. Any cause of action you may have with respect to the Content, Site or the Agreement must be commenced within one (1) year after the claim or cause of action arose or is barred. Additional written terms and conditions posted on the Site or executed in writing with You, including but not limited to, a Privacy Policy, govern use of the Site and Content and supersede any and all oral or written communication between the parties concerning the Site and Content.
